The Connotation of the General Legal Principle as the Source of the International Law

《国际法院规约》第38条第1款第3项明文规定了"一般法律原则",这一规定是出于适应国际法现实发展变化的需要。文章从历史源流和文本本身两个层面理清了作为国际法渊源的一般法律原则的内涵,提出对于一般法律原则的内涵的理解应首先要求其必须是各国国内法上共有的原则,其次通过比较世界主要法系主要代表国家的国内法得出。

Statute of the International Court of Justice（ ICJ） article 38（ 1） item 3 sets out the＂general legal principle＂ of the international law,which is the requirement of adapting to the development of international law. The paper clarified the connotation of the general legal principle as the source of the international law from both historical headstream and text itself,put forward that the understanding of the connotation of the general legal principle must be the common principle shared in the national laws. Secondly,it is got by comparing the domestic law of the representative countries of the major legal systems of the world.
