大数据视角下的司法改革:机遇与挑战

国务院在2015年8月印发的《促进大数据发展行动纲要》中明确提出要"通过促进大数据发展,加快建设数据强国"。党的十九大报告更是明确要求"推动互联网、大数据、人工智能和实体经济深度融合"。在2017年12月8日下午中共中央政治局就实施国家大数据战略进行第二次集体学习时,习近平总书记特别强调要"深入了解大数据发展现状和趋势及其对经济社会发展的影响,分析我国大数据发展取得的成绩和存在的问题,推动实施国家大数据战略"。国家最高司法机关对于司法大数据的建设和研究也高度重视。最高人民法院早在2016年11月10日就成立了中国司法大数据研究院,最高人民检察院也于2017年9月21日成立了智慧检务创新研究院。在大数据已经上升到国家战略的背景下,司法实务部门对司法大数据的研发如火如荼,诸如何谓司法大数据、如何收集司法大数据、如何研究和开发司法大数据、司法大数据对司法的未来带来哪些颠覆性变化和革命性冲击等基础性问题,都已经被涉及和关注。基于此,本刊特组织相关专家对"司法大数据的挑战与机遇"专题展开研讨,以期引发学界对司法大数据研究的高度重视,推动司法大数据的研究向纵深发展。

In August 2015,the State Council released " Action Plan for the Promotion of Big Data Development" which clearly states that " we should speed up the construction of a great power with big data by promoting the development of big data. " The report of the 19 th CPC Congress explicitly stipulates that " we should promote the in-depth integration of the Internet,big data,artificial intelligence and the real economy. " With big data being regarded as the national strategy,the judicial practice departments have studied judicial big data in full swing,while the academic research on judicial big data is lagging behind. Up to now,no research has yet been done on the basic issues like what constitutes judicial big data,how to collect judicial big data,how to study and develop judicial big data,what subversive changes and revolutionary shocks that judicial big data bring to the future justice. Therefore,this publication organized relevant experts to discuss on the topic of " Challenges and Opportunities for Judicial Big Data",aiming at triggering academic circles' attention to the research on judicial big data and promoting the research on judicial big data to develop in its depth.
