摘要
伯克利学派主张法律需要重视规范、国家制度、政策和立法价值的研究,学派代表赛尔兹尼克和诺内特在合著著作《转变中的法律与社会：迈向回应型法》一书中将伯克利学派的理论纲领和方法论充分说明,利用＂伯克利观察法＂创造性提出＂回应型＂法的法律发展范式,进一步对法律进行分类,透过＂压制型法——自治型法——回应型法＂的路径进行法社会学分析,结合实际情况寻找法律发展适应社会的出路。＂回应型＂法的发展范式也为我国法治国家的建设提供了新的思路。
Berkeley School advocates that the law should pay attention to the researches on legal norms,state systems,policies and the values of legislation,and the representatives of this school,Selznick and Nonet,fully explain the Berkeley School＇s theoretical guidelines and methodologies in their coauthor book Law and Society in Transition： toward Responsive Law. They creatively propose the paradigm of legal development of responsive law using ＂Berkeley Perspective＂,further classify the law through the method of＂repressive law-autonomous law-responsive law＂to carry on the analysis of Sociology of Law,and find a way for the legal development adapting to the society according to practical situation. The development paradigm of ＂responsive law＂also provides a new way for the construction of our country ruled by law.
