网络借贷的行政监管与刑法规制

网络借贷目前已成为我国金融体系中的重要部分,行政监管体系也在逐步完善。在新的监管环境中,网络借贷平台应积极主动满足"合规"要求,降低自身涉嫌非法吸收公众存款罪的风险。刑法及解释采用规制间接融资的方式规制非法集资行为,现有监管条件下借款人构成非法吸收公众存款罪的风险仍然较高。监管规则为刑事司法认定"以非法占有为目的"提供了明确的依据,为认定违规运营的网贷平台和借款人构成集资诈骗罪提供了便利。在当前经济环境中,应进一步完善网络借贷的监管规则,落实各项监管措施;坚持刑法的谨慎介入,严厉打击已识别的严重违规行为,调整相关犯罪构成的规定,为网络借贷的良性发展预留空间。

Peer-to-peer lending has become an important part of China＇ s financial system, and the administrative supervision system has gradually improved. In the new regulatory system, the P2P platform should actively meet the compliance requirements, and reduce their own risk of illegally absorbing the crime of public deposits. Criminal law regulates all the illegal money-raising behaviors by regulating indirect financing. The risk that the borrower constitutes an offense of illegally absorbing public deposits is still high. The rules of regulation provide a clear basis for criminal justice about ＂for the purpose of illegal possession＂ , and providing convenience for the judgment whether the P2P platform and the borrower constitute the crime of fund-raising fraud. At present, Regulatory rules for online borrowing should be further refined, the regulatory measures should be implemented, and intervention of criminal justice should be careful. At the same time, the serious violations that have been identified should be severely cracked down. The provisions of the relevant criminal composition shall be adjusted for the healthy development of on-line lending.
