从专利法立法宗旨出发,结合专利申请权、专利权转让状况,引出专利申请权、专利权转让声明作用及意义,针对专利请求书、专利申请或专利权公报、专利登记薄等,提出了专利申请权、专利权转让声明实现形式和内容,结合发明、实用新型、外观设计专利申请权和专利权国内国外转让声明形式,介绍了专利申请权、专利权转让声明的功能,明确了法律基础与法规实现形式,申请人、受让人对其声明的应对策略。推动发明创造的应用,提高技术实施和保护范围,降低社会成本。

Based on the legislative purpose of patent law, combined with the situation of patent application right and patent right transfer, leads to the affect and significance of patent application right and patent right transfer, according to application form for patent, patent application gazette or patent gazette and patent register, etc., this paper brings out realization and contents of patent application right and patent right transfer. Combined with realization of patent for invention, utility model and design, and realization of foreign and domestic patent right transfer, this paper describes the function of statement on patent application right and patent right transfer, expounds legal bases, realization of legislation and response of applicant and concessionaire to statement from themselves, to promote the usage of invention-creations, widen technology implementation and extent of the patent protection and reduce society cost.
