身体在西方学术话语中是一个重要的关键词，在中国尤其是法学界对此分析少见。实际上，跳出生物一生理学约束，身体是在社会一政治框架下作为建构的存在。中国共产党对婚姻的立法史，正是对身体不断塑造和建构为符号同时态的符合政治与社会变迁的过程。身体从客体转变为主体，从禁锢的传统权力中解放出来，通过法律来释放它应有的张力。在当代，社会多元背景下身体秩序（婚姻）的表达越来越多元，甚至与法律不相同的路径，表明身体作为被建构者到建构者的一种微观历史进程。
