摘要
梳理科学学科的发展历史和划分标准,评价西方关于能源法学的研究动态,立足于中国问题,可以确认能源法学是一门具有重要现实意义的、处于成长期最后阶段的新兴学科和交叉学科。就学科的内在条件来说,该学科的研究对象、特征、研究方法论、派生来源以及研究目的和目标等五个方面都已经具有较强的独立性。从学科的外在表现条件来看,该学科已经形成了自己的理论体系和具有特色的研究方法论,其科学家群体已经出现,能源法学相关的研究机构和教学单位以及学术团体已经建立并开展了大量有效活动,许多能源法(学)相关的专著和出版物相继出版并具有了相当影响。于理论构建方面,能源法学的体系应该由总论、能源生产供应分论和节能减排分论三个部分组成;两个分论的结构在于大体上对应确保能源供应安全以及将温室气体排放控制于一个适当水平这两个能源议题的核心问题。
Teasing the development and dividing criteria of scientific disciplines, evaluating the research trends on the science of energy law in western countries, from a Chinars perspective, it could be demonstrated that the science of energy law is an emerging and interdisciplinary discipline with important practical significance. In terms of the internal conditions of a discipline, the science of energy law is of strong independence in the following five aspects, i. e. , research subjects, research characteristics and methodology, derived sources of the discipline, research purposes as well as research objectives. Regarding the external performance conditions, the science of energy law has its own theoretical system, and has formed methodology with its own characteristics, while a group of scientists in the field has emerged, many research institutions and teaching units as well as academic groups in the field have carried out a large number of effective academic activities, many monographs and articles in the field have been published and have considerable influences. For constructing the theory of science of energy law, the system of science of energy law should consist of the following three parts, i. e. , general theory, and energy production and supply as well as energy conservation and reduction of greenhouse gas em- missions; the last two parts correspond to the two core energy issues, i.e. ensuring the security of energy supply and controling greenhouse gas emissions to an appropriate level.
