The Asian Infrastructure Investment Bank and the Protection of Human Rights

亚洲基础设施投资银行是全球首个由中国倡议设立的多边投资机构,对于为亚洲地区互联互通建设提供新的融资机制,共同促进亚洲经济持续稳定发展,推动亚洲经济一体化的进程,具有积极意义。由于亚洲地区自然环境和社会环境的特殊性,亚洲基础设施投资银行在运作过程中,将会面临众多的人权、环境等问题和风险。为此,本文以亚洲基础设施投资银行在运作过程中所依据的《亚洲基础设施投资银行协定》和《环境和社会框架》为基础,对其可能遭遇到的人权、环境等问题进行分析,并结合包括世界银行和亚洲开发银行在内的国际多边金融组织的经验和教训,强调亚洲基础设施投资银行应当采取积极的人权保护措施,以防止出现投资项目带来的人权和环境风险。

The Asian Infrastructure Investment Bank(AIIB) is a multilateral development bank(MDB) established by the initiative of China.AIIB aims to provide a new financing mechanism for the interconnection among the Asian region,jointly promotes the sustainable and stable development of the Asian economy and contributes to the process of Asian economic integration.Because of the particularity of the natural and social environment in Asia,the AIIB should pay abundant attention to the protection of Human Rights.The article presents an analysis of the potential human rights issues faced by the AIIB through the experiences of World Bank and Asian Development Bank.It also provides some possible human rights strategy to the AIIB in order to avoid any human rights and environment risks arising from its projects.
