国际著作权保护问题管窥及启示——基于TRIPS协议的视角

Study on Protection of International Copyright from the Perspective of the TRIPS

《与贸易有关的知识产权协议》是世界贸易组织(WTO)最重要的协议之一,简称TRIPS协议。TRIPS协议确认版权为私权,并在第二部分第一节对版权与有关权(著作权)作了规定,为国际贸易中的版权保护确立了一系列新的标准和制度。TRIPS协议签订后,世贸组织和知识产权组织相互协调,促进了版权贸易的国际著作权保护体制朝着全新的方向发展,这些变化对于解决当今存在的国际贸易著作权保护问题非常有利。

Agreement On Trade-Related Aspects of Intellectual Property Rights is one of most important agreements of World Trade Organization （WTO） and was called TRIPS agreement. TRIPS confirmed that copyright belongs to privacy right. In Section I of the Second Part, it defines copyright and related rights （literary property） and provides a series of new standards and systems for copyright protection in international trading. After TRIPS is reached, World Trade Organization and the World Intellectual Property Organization goes hand in hand and work together to promote and coordinate the worldwide trade in the international copyright laws protection system, which is conducive to solve the problem of copyright protection in the field of international trading.
