关于我国刑事责任能力理论的探析

Probe on Theory of National Criminal Responsibility

刑事责任能力是刑法理论的重要概念之一。我国刑法学界对于刑事责任能力的定义主要有三种观点。笔者在对上述观点进行分析与反思的基础上,指出我国的刑事责任能力概念应当是犯罪能力和影响刑事责任能力的统一。

Criminal responsibility capability is one of the key concepts in theory. Three definitions made by crime and law study field in cludes crime committing capability,responsibility bearing capability and combination of above two. Based on relative opinions,analysis and consideration pointed out as the result of integration of first two.
