酷刑罪的举证责任倒置

Responsibility Shifting for Showing Evidence in Crime of Savage Torture

酷刑罪是典型的国际犯罪之一,但我国还没有关于酷刑罪的定义。本文结合国际文件上酷刑罪的一些规定提出定义酷刑罪的建议。文章还分析了酷刑罪的主体特征和隐蔽性特征,从而提出对酷刑罪应当实施举证责任倒置,并且提出了在国内法中实行举证责任倒置的必要性和可行性。最后,文章讨论了举证责任倒置和无罪推定的关系,提出罪错推定可以作为我国刑法中有罪推定的一种补充。

Crime of Savage Torture is typical one of the international crimes,which is of no legal definition in our country.So following suggestions have been given based on some international documents and analysis made on obvious and hidden features of the crime,thereby,to present the opinion of responsibility shifting for showing evidence in savage torture crime and its necessity and feasibility.Finally,relation between the above and presumption of innocence discussed to prevent presumption of guilt can be treated as a supplement to related term in Criminal Law.
