简论我国人民陪审制度

On People's Jury System

我国的陪审制度是人民陪审制度,是我国的一项基本诉讼制度,是促进司法民主、保障司法公正、维护司法独立的重要举措,在我国的审判工作中发挥了重要的作用。但同时人民陪审制度仍存在着一些问题和不足,人民陪审制度的立法位阶较低,司法实践中流于形式等使得我国的人民陪审制度的作用没有得到充分的发挥。由于人民陪审制度在理论界与实务界的重要意义与重大价值,因此,对人民陪审制度进行改革使之不断得到完善势在必行。

Chinese jury system is the people's jury system;it is a basic system of litigation,which starts from revolutionary base period.Chinese people's jury system is an important measure to promote judicial democracy,to ensure judicial justice,safeguarding the independence of the judiciary and plays an important role in Chinese judicial work.But at the same time the people of our country's jury system there are still some problems and deficiencies,and the people's jury system in order lower the legislative,judicial practice of a mere formality,and so the value of jury system has not been fully exploited.However,because the people in the jury system of community and the important practical significance and of great value,so in order to perfect this system,reform about the people's jury system is inevitable.
