摘要
警察权是国家行政权力的重要组成部分和强力保障,既关系到政府的运作也涉及每一位公民的基本人权。它是一把"双刃剑",警察权的设置不合理及其违法行使和滥用不仅会损害公民、法人和其他组织的合法权益,也会造成运行的不畅和对社会的危害。因此,在积极推进依法行政、建设和谐社会和法治政府的进程中,必然要求对现有警察权进行重构,即在法治视野下重新审视和构建警察权力。
Police right serves as an important role in national executive power and a strong guarantee,uhich concerns not only government operation but basic right for each citizen,so it's called'double-edged sword'owing to its unrational arrangement and illegal abusing may damage the interests of the people,corporations and legal organization;therefore,it affects advancirg performance of society;thus,reconstruction of police right is to be required based on ruling process by law and building up harmious society.
