基层公安刑事执法中存在的问题探析

基层公安刑事执法中,由于极少数民警法治观念淡薄、特权思想严重以及受利益驱动因素影响,一定程度上存在着违法取证、以罚代刑等违法问题。这些问题的存在,侵犯了公民的基本权利,降低了法律的权威,损害了公安机关的形象,必须通过加强立法、健全制度、强化教育加以解决。

During grass-roots public security enforcing the law,because of the legal sense of the very small number of police rule of law thin,the privilege of thinking seriously,and driven by profit factors,so to some extent,there still exist some illegal evidence,such as punishment Substituting penalty and illegal forensics and so on. The existence of these problems,which is violating the fundamental rights of citizens,reducing the authority of the law and damaging the image of the public security organs,all which must be solved by strengthening the legislative,sound system,and strengthen education.
