建立和完善行政类执法与刑事司法制度对接机制是健康有序的社会主义市场经济的自身的、内在的要求,也是维护社会主义法制统一,实现社会公正的必然要求。但是近年来在整顿和规范市场经济秩序的过程中,仍然暴露出了行政执法与刑事司法在衔接中的一些问题,产生这些问题的原因除了破坏市场经济秩序犯罪本身的复杂性以及地方保护主义和利益驱动外,一个重要原因就是行政执法与刑事司法相衔接的工作机制还不够完善,应当有一系列的配套制度加以保障,以提高行政执法机关与刑事司法机关打击犯罪的合力。

Establishing and perfecting docking mechanism of administrative law enforcement and criminal justice system is healthy and orderly own internal requirements of the socialist market economy, but also is the inevitable requirement to maintain the unity of the socialist legal system, and the realization of social justice. However, in recent years, in the process of rectifying and standardizing market economic order, it still exposes some of the problems of the administrative law enforcement and criminal justice, the reasons for these problems, besides the destruction of the market economic order, local protectionism and interest-driven, an important reason is that the administrative law enforcement and criminal justice dovetail mechanism is not perfect, there should be a series of supporting systems to be protected in order to improve the resultant of the administrative and law enforcement authorities and criminal justice agencies work together.
