近代国际法视野下的“孙中山伦敦蒙难案”和“林维喜案”

Analysis of the Case of Sun Yat-sen Being Kidnapped in London and the Case of Lin Wei-xi from Perspective of Modern International Law

"孙中山伦敦蒙难案"和"林维喜案"是发生在近代中国和英国之间的两个著名案件,它们都涉及近代国际法上的属地管辖权与属人管辖权之争。英国政府在处理这两个同类案件过程中实行的是双重标准,遵循的是国家利益至上原则。通过对两案的对比分析,可以看出英国在执行国际法以及外交政策时的霸权主义实质。

The case of Sun Yat-sen being kidnapped in London and the case of Lin Wen-xi were two well-known cases happened between China and Britain in early 20 thcentury, which involved priority of territorial jurisdiction versus personal jurisdiction. British government took double standards in handling these two cases of the same sort and followed the principle of national interest supremacy. By comparing these two cases, we can observe hegemonism of Britain in its implementing international law and foreign policy.
