高校学生处分的法律风险防控

随着大学生权利意识的日益增强,高校学生处分工作面临的法律风险也在增多。在实践中,关系学生身份权利义务变动的处分行为具有司法上的可诉性。依据最新修订的《普通高等学校学生管理规定》,结合相关理论和工作经验,可以发现,高校学生处分工作的薄弱环节集中在处分工作机制、处分依据等方面。高校学生处分的法律风险防控必须全面加强,并重视证据收集、处分决定送达、上报审批和学生申诉等环节。

With the increasing of college students＇ rights awareness, the legal risks of disciplinary work of university students are also increasing. In practice, the disciplinary actions concerning students＇ rights and obligations may be litigable. In line with the latest revision of ＂Provisions on the Administration of University Students＂, combining the theory with experience, we found that the weak links of college student punishment work focus on the disciplinary work mechanism and disciplinary basis, etc. Therefore, works of legal risk prevention and control of college students must be strengthened comprehensively and more importance should be attached to the collection of evidence, the service of the disciplinary decision, the report and approval, and the student＇s appeal.
