论民事诉讼文书样式实例评注研究的引领功用

On the Leading Function of the Instance Commentary Research on the Civil Litigation Document Style

结合当前民事裁判文书说理不充分的现实困境,以法律评注研究在中国民事司法实践中的应用为研究对象,通过分析民事诉讼裁判文书说理不充分的深层次原因,将司法案例研究和法律评注研究方法与强化民事裁判文书说理改革相结合,倡导司法案例研究和法律评注研究相结合的民事诉讼文书样式实例评注研究方法。提出通过民事诉讼文书样式实例评注研究范式的本土化路径与方法研究,探寻文书样式和裁判要旨对民事诉讼案件审判中的诉讼行为、诉讼程序、案件管理、法律解释、法律适用等的规范性指引作用,进一步拓宽强化民事裁判文书说理的文书制作、写作与创作思路,寻求提升民事裁判文书判决充分说理的司法职业技能培育方法。进而论证推行法官员额制改革、司法责任制改革和审判权力运行制度改革后,司法综合配套改革应当如何引领民事诉讼裁判文书说理机制改革的发展方向。

Based on the problem of insufficient reasoning in the current civil litigation judgment, the paper takes the application of legal commentary research in civil judicial practice in China as the research object. By analyzing the deep-seated reasons of the inadequacy of the reasoning in the civil lawsuit judgment, and combining the judicial case study and the law commentary research method with strengthening the reasoning reform of the civil lawsuit judgment document, this paper studies the instance commentary method of the civil litigation document styles which unifies the judicial case study and the legal commentary research. This paper puts forward the research on the localization path and method of the study paradigm of the pattern of civil litigation document styles, and explores the normative guidance function of the document style and gist of adjudication to the lawsuit behavior, lawsuit procedure, case management, legal explanation and law application in the trial of civil lawsuit. The research has further broadened the thought of making, writing and creating the civil litigation judgment document, which is the center of reasoning, and seeks to raise the judicial vocational skill cultivation method to enhance the reasoning of civil judgment documents. Then it proves after the reform of the judge quota system, the judicial responsibility system and the running system of the judicial power, how the comprehensive reform of the judiciary guides the development direction of the reform of the rational mechanism of civil litigation judgment documents.
