Analysis on the Copyright Legality of Preserved Works in Institutional Repositories

厘清和明辨机构知识库保存作品的版权合法性问题,对于科研人员、高校师生了解出版商存档政策,掌握作品正确的提交版本和提交时间具有广泛而实际的指导意义。文章比较了印本文献、电子文献和机构知识库作品三者之间的版权风险,论述了开放获取政策的效力。研究发现,机构知识库作品财产权的侵权风险并不高,开放获取政策以及出版商存档政策,决定了知识库存档作品的版权是否具有合法性。

It has an extensive and practical significance to make clear and discriminate the copyright legality of preserved works in institutional repositories and master the correct submission and submission time for the scientific research staff as well as university students and teachers. This article compares the copyright risk between the printed journals, electronic journals and preserved works in institutional repositories and analyzes the validity of OA policy. The result shows that the infringement risk of copyright of institutional repository is not high. The legality of the preserved works is decided by the OA policy and publisher＇s archiving policy.
