开放教育学习权保障制度研究

A Research on Supporting System of Learning Right in Open Education

学习权是每个公民所应享有的基本人权,开放教育在很大程度上保障了成人的学习权,通过对开放教育学习权保障制度分析可以看出,开放教育学习权保障在制度上还存在着一定的缺陷:学习者学习权能缺陷、弱势群体救济缺陷、学习者学习权益保障缺陷等,说明需要多角度完善开放教育学习权保障制度,更全面保障成人受教育者的学习权。

Learning right is one of the basic human rights that every citizen should enjoy,and open education,to a great extent,guarantees the learning right of adult.Through the analysis of supporting system of learning right in open education,this paper shows that there still exist some shortcomings in supporting system of learning right in open education,namely,the defect of learners＇ learning right,the defect of relief for vulnerable groups,the flaw of supporting measures for learners＇ learning rights,etc.The paper,therefore,proposes that the supporting system of learning right in open education should be improved and perfected from various angles,making the supporting system of learning right more comprehensive and complete for adult.
