建设工程合同参照点相对值、公平感知与承包人履约行为

Reference Point Relative Value of Construction Contract,Perception of Fairness and Contractor′s Performance Behavior

基于契约参照点理论构建了建设工程合同参照点效应模型，提出了承包人履约行为的研究假设，试图探索建设工程合同参照点效应的形成机理。研究借鉴行为经济学的相关研究方法，设计了情景实验，结果表明：①建设工程合同存在参照点效应，即承包人的履约行为受到初始合同参照基准的影响；②建设工程合同参照点效应对承包人字面履约行为影响不显著，对机会主义行为和尽善履约行为影响显著，但不同合同类型形成的参照点不同，对承包人履约行为的影响存在差异；③公平感知是合同参照点效应下行为诱导的内在逻辑。

The model for reference points effect in construction project is built based on the theory of contract as a reference point. The proposed hypotheses tried to reveal the influence mechanism on how the contract reference point effect influence the performance behavior of contractors. Situational experiment was designed using behavioral economics research methods. The results show that： （1）There are reference points effect in construction contract where the contractorsr performance is influenced by the initial contract; （2）The effect of contract reference point has not significant influence on contractor＇s literal compliance behavior,hut has significant influence on contractor＇s performance behavior and opportunistic behavior. However, different contract types form different reference points,which lead to different influence;（3）Fair perception is the internal logic of the behavior induced by the contract reference point effect.
