改革开放40年我国专利制度的回顾、反思与展望

改革开放40年,我国专利制度历经了从无到有、着眼全球、制度创新,与时俱进、驱动创新等几个历程。应当说,改革开放以来我国经济发展所取得辉煌成就离不开我国专利法的积极贡献。随着国际国内经济形势的演变,我国专利法也在历次修订中渐近完善和成熟,法律保护水平也逐步提高。借助于专利法制度优势,发明人的创新精神受到极大鼓舞,以专利为核心的新经济格局也渐近形成。当前,我国专利法正面临着第四次修订,以期在全面总结改革开放40年专利法律保护经验的同时,全面升级现有专利制度,更好地适应新时期我国社会的转型升级。需要指出,任何一次技术的巨大变革都会对专利制度形成冲击,放眼人工智能时代,如何布局和设计我国的专利制度仍然是一个有待继续研究的问题。

China patent legal system has experienced several of stages ： the emergence of patent law,being favorable for the internationalization, motivation for improving the level of protecting patent and comprehensive upgrading. Patent law has played an important role in China achieving huge success in the process of reform and opening.Until now, patent law has already experienced three modifications to adapt to the changes of international and domestic economic situation. Thus, the innovations are greatly encouraged by the patent legal system and the new economic landscape based on patent and high-tech has been gradually described. On the experience of forty the 4th modification of patent law is expected to years of chinese reform and opening-up, raise patent protection level in reaction to China＇s society transformation and upgrading. It is necessary to point out that the patent law has been challenged by every technology revolution, so it is worth studying further how to perfect the patent legal system in the era of artificial intelligence.
