软法视野下粤港澳大湾区合作治理机制研究

Research on the Mechanism of Cooperative Governance in Guangdong,Hong Kong and Macao Great Bay Area from the Perspective of Soft Law

粤港澳大湾区的建设需要相应的法律制度安排,在粤港澳大湾区硬法建构无法短时间内完成的前提下,以软法为视角,着力构建软硬法协同化发展格局,健全湾区软法治理框架,发挥软法多元治理的＂功能约束＂,丰富区域治理手段,或是可行之举。

The construction of the Guangdong, Hong Kong and Macao Great Bay Area requires the corresponding arrangement of legal systems. Under the premise that the hard law construction of Guangdong, Hong Kong and Macao Great Bay Area can not be completed within a short period of time, from the perspective of soft law, ef-forts should be made to establish a coordinated development pattern between hardware and software and to im-prove the Bay District soft law governance framework, to play the ＂legal constraints＂ of the soft law multiple governance, enrich the regional governance, or feasible action.
