The Predicament of Human Existence Under the Rule of Law

人类自产生伊始,就不断为了自身的生存利益而斗争;这种斗争自阶级社会出现、自社会经济飞速发展之后更加激烈。与学理上的生存权不同,生存利益伴随着人类而出现,但却具有更加广泛的内容。虽然人类享受着生产力提高之后带来的巨大经济、社会福利,但是由于历史发展、制度设计、地理位置等原因,还有很多人群时刻饱受生存之困的煎熬。在当前加速建设社会法治国家的关键时期,如何有效发挥宪法和法律对于维护人类生存利益的作用成为一个必须解决的时代课题。

From the moment of its birth,mankind is under tremendous pressure of subsistence. Since the birth of class,the ruling class has survived this kind of pressure with difficulty and has repeatedly launched an insurrection movement or improvement under circumstances in which the right to subsistence can not be guaranteed movement. With the constant development of economy and society,every one of us is under constant pressure at every moment. The fast-growing economy and society make people living in it feel the squeeze feeling from all directions. Economic and social development has brought about an increase in the total mass of the whole society on the one hand,and on the other hand,the promotion of the rule of law has continued to deepen. However,due to the distribution and other reasons,more and more people are living in difficulties,living conditions should be carefully pondered the issues related to the survival benefits.
