专家辅助人制度解析与完善

Analysis and Improvement of Expert Assistance System

我国2012年修订的《刑事诉讼法》首次确立了专家辅助人制度,这一制度的确立标志着我国司法鉴定制度改革又迈入新的台阶。但是,由于目前缺少具体的法律制度对其进行规范,因而在司法实践中专家辅助人制度存在运行状况混乱、角色定位不清等问题。从目前立法现状以及实践入手,分析专家辅助人的角色定位以及专家辅助人意见属性,并结合实际提出完善专家辅助人制度的相关建议,以求为专家辅助人制度改革提供借鉴。

＂ Criminal Procedure Law of People＇s Republic of China＂ revised in 2012 estsblished the systern of expert assistsnce system for the first time. This enhsnced the examinstion and evidence confirmation of spprsissl opinions,and demonstrsted that the reform of China＇s judicial expertise system has stepped into a new stage. However,becsuse of no concrete lsw system that can normalize the expert assistance system,there exist some problems about expert assistance system in the judicial practice such as the confusion of operating ststus snd the unclear position of roles. Therefore, starting with the discussion of legislative ststus snd practice, the paper snslyzes the role orientation and opinion attribute of expert advisors, and then combined with the reality, puts forwrd some relevant suggestions to improve related expert assistsnce system in order to provide some references for the reform of expert assistance system.
