Legitimacy Analysis of Labor's Collective Action in the Context of Social Law

在社会法语境下,劳动者集体行动合法性的内涵应当包括法律规制、道德层面和认知层面。我国劳动者的集体行动在合法性三个层面的不完备状态,产生了一系列的问题,包括形式法治产生的消极路径依赖、非正式规则形成的负面效应,以及阻碍了劳资矛盾解决的制度化构建。基于这些问题在权利定位和治理体制的深层根源,从权利可实现的角度来看,与其仅仅从法律文本或者道德规范上主张权利,毋宁重新审视合法性的实践途径:在资源的优化配置中解决集体行动合法性的产业基础问题;在推进集体协商的机制建设中解决合法性面临的实践问题;在劳动关系伦理的实践中化解合法性存在的认知危机。

In the context of Social Law, the connotation of the legitimacy of collective action of labor＇s should include legal regulation, morality and cognition. The incomplete state of our collective action on three levels of legitimacy has caused a series of problems, including the negative dependence of the formal rule of law, the negative effect of informal rules and the institutionalized construction that hinders the solution of labor and capital contradictions. Based on the deep roots of these problems in the system of right orientation and gover- nance, from the viewpoint of right realization, rather than just claiming the right from legal texts or ethics, we should rather re-examine the practical ways of legitimacy： the industrial basic problem of solving the legitima- cy of collective action in the optimal allocation of resources; solving the practical problems of legitimacy in the construction of the mechanism of collective consultation; the cognitive crisis to resolve the existence of legiti- macy in the practice of labor relations ethics.
