反垄断法宽大制度是通过激励垄断协议参加人检举揭发违法行为,帮助执法机关发现垄断协议案件而创设的一项重要制度。该项制度的有效实施除需要完善的实体规则外,更需要申请与受理等程序规则的充分保障。由此,我国应当构建完善的宽大制度申请与受理程序。通过引入事前咨询程序,以便为潜在的申请者提供明确的行为指引;建立优先序位保留的登记申请制度,以便促进申请者尽早申请、执法机关及时发现违法;完善格式化的书面申请方式、明确的口头申请情形、规范化的受理程序,从而提升宽大制度适用的确定性、便捷性,促进反垄断法宽大制度的有效实施。

The leniency system of China's anti-monopoly law is an important system established by encouraging participants in monopoly agreements to expose illegal activities and help law enforcement agencies find monopoly agreements. The effective implementation of this system requires both perfect entity rules and the full protection of rules for application and acceptance procedure. Introducing the procedure of prior consultation can provide potential applicants with clear guidelines. Establishing a registered application system of prioritized reservation can facilitate applicants to apply as soon as possible and law enforcement agencies to detect violations without delay. Improving the format of written application,clearing the oral application conditions and standardizing acceptance procedures will improve the certainty and convenience of the application of the leniency system and promote the effective implementation of the leniency system of the anti-monopoly law.
