摘要
在"大众创业、万众创新"的时代背景下,越来越多的高校学生利用课余时间到校外兼职。兼职学生被用人单位雇佣,获取相应的劳动报酬,是法律意义上的劳动者从事有偿劳动的行为。但由于相关立法不完善以及高校勤工助学管理机制滞后等原因,高校学生在兼职期间合法权益受侵害的现象时有发生,且其权益受侵害后的法律救济往往会陷入困境。对此,本文认为,应通过完善相关立法、强化社会责任、加强学校监管使国家、社会、学校三方形成合力,为高校学生校外兼职创造良好的法律环境。
Under the background of "Mass Entrepreneurship and Innovation",More and more students of colleges and universities use their spare time to accumulate social experience,prepare for future venture employment.Part-time students are employed by the employer,to obtain the corresponding labor remuneration,is the legal sense of the workers engaged in paid labor.During the part time, the students' legal rights and interests are violated,however,due to the relevant legislation is not perfect and the work study program management mechanism lags behind and infringement of rights and interests of legal relief in trouble.At present,China should proceed from the country,society,colleges and universities and other three parties to form a concerted effort,through the improvement of national legislation,strengthen social responsibility,strengthen school supervision,establish and improve the regulation of off-campus part-time market legal system,for the part-time to create a good legal environment.
