摘要
"一带一路"背景下,沿线国家对于"设施联通"的基础性需求加之中国日益精进的铁路建造技术,为中国铁企大量走向国际市场作了铺垫,但铁企的海外腐败问题却缺乏有效的制约。一方面,铁企的海外经营需要处理东道国政治生态、腐败状况和法律冲突;另一方面,相关法律配套机制不完善、国内外反腐资源分配不均及企业自身管理漏洞等三方面问题也亟待解决。为助益"一带一路"沿线市场的健康发展、呼应国内反腐高压及配合国家监察体制改革,宜合理配置反腐资源、完善法律配套机制及加强沿线各国对话协商,通过多种路径重构我国海外反腐模式。
Under the background of " the Belt and Road", the basic needs of facilities and communications along the line and Chinag increasingly sophisticated railway construction technology have paved the way for a large number of Chinese railway enterprises to enter the international market. However, there is a lack of effective re- strictions to the corruptions overseas. On the one hand, the overseas operation of the railway enterprises needs to deal with the host countryg political ecology, corruption and legal conflicts; on the other hand, the related legal supporting mechanisms are not perfect, the distribution of anti - corruption resources at home and abroad is une- ven, and the enterprises themselves manage the loopholes. In order to facilitate the healthy development of markets along " the Belt and Road" , echoing the domestic anti - corruption pressure and the reform of the national monito- ring system, it is advisable to allocate more resources, improve legal support mechanisms and strengthen dialogues and consultations among all countries along the route and to rebuild our overseas anti -corruption mode.
