Countermeasures Research on the Protection of Intellectual Property in the New Era

改革开放以来,我国知识产权保护从无到有、由弱到强,有力保障和推动了我国经济增长、科技创新和对外贸易的快速发展。但对标新时代新任务,对标党的十九大提出的新要求,我国知识产权保护还存在一些不相适应的地方。在此基础上,本文探索提出新时代强化知识产权保护的工作思路,分三个阶段逐步构建起以"司法保护+行政执法"两条途径为基础,"严保护、大保护、快保护、同保护"协调发展,司法保护、行政执法、社会治理"并行运作、相容互补、司法终局"的知识产权保护"中国模式",加快建成世界一流、中国特色的知识产权保护强国,为世界知识产权保护提供"中国方案"。

Since the reform and opening policy, the protection of intellectual property in China has underwent a period from nonexistence to existence, from feebleness to strong, which guarantees and promotes the rapid development of China＇s economic growth, scientific and technological innovation and foreign trade. But compared with the new tasks of the new era and the new requirements put forward by19 th CPC National Congress, there are still some unsuitable points for the protection of intellectual property in China. Based on this, this paper explores ideas of strengthen the protection of intellectual property, and gradually built a ＂Chinese model of the protection of intellectual property＂ in three stages, which based on the ＂judicial protection and administrative enforcement＂, with coordinative development of ＂strict protection, general protection, quick protection and equal protection＂, and in which judicial protection,administrative enforcement and social governance operate together, complement each other, and end with judiciary. Accelerate the establishment of the world first class intellectual property protection power with Chinese characteristics, providing a Chinese programme for the world＇s intellectual property protection.
