当前,数字贸易发展迅猛,其新型发展模式正在引发国际贸易规则的深刻变革。世界主要发达国家纷纷着手制定数字经济相关发展规划,并积极探索制定数字贸易规则,以期获得国际规则制定的主导权。美国倡导数据的自由流动,但在数字本地化、隐私保护等方面与欧盟难以达成一致,与中国在数据跨境流动和源代码规则方面也存在较大分歧。我国应充分发挥在跨境电子商务领域的领先优势,构建符合我国国情和自身利益的数字贸易规则。

At present,the digital trade is developing rapidly,and its new model of development is causing profound changes in international trade rules.The main developed countries in the world have begun to formulate the relevant development plan of digital economy,and actively explore the formulation of digital trade rules,in order to get the dominant power of international rule making.The United States advocates the free flow of data,but the US has difficulty in reaching agreement with the European Union in terms of digital localization,privacy protection and so on,and has huge difference with China in the areas of cross-border data flow and source code rules.China should give full play to the leading advantage in the field of cross-border e-commerce and build the digital trade rules that meet the national conditions and own interests of our country.
