论网络舆论与司法互动的价值合理性

On the Value Rationality of the Interaction of Network Public Opinion and Judicial Trial

网络舆论与司法之间已形成事实上的互动关系,两者的互动蕴含着价值合理性:网络舆论关注司法案件蕴含着民众对言论自由与公平审判的价值追求,是言论自由在司法领域的集中体现、有利于维护实体公正、防止司法审判权的滥用及提升民众公平正义的获得感;司法回应网络舆论关切,蕴含着对司法公开的价值追求,是满足民众的司法知情权、引导网络舆论朝着真相和正义方向发展、增强民众对司法审判结果认同感的必要选择;网络舆论与司法良性互动关系的价值目标是实现社会正义。

The interaction relationship has been actually formed between network public opinion and judicial trial,which implies value rationality： network public opinion focusing on judicial cases contain public value pursuit of speech freedom and fair trial,which is the concentrated expression of freedom of speech in the judicial field,and it is conducive to maintain substantive justice,to prevent the abuse of judicial power and enhance the people＇s acquisition sense of fairness and justice; Judicial trial responses the concern of network public,which contains the value pursuit of judicial openness,it is necessary choice to satisfy the people＇s right to know in the judicial trial,to guide network opinion towards truth and justice,to enhance people＇s sense of identification with judicial trial results. The value goal of positive interaction between network public opinion and judicature is to achieve social justice.
