"一带一路"背景下衍生的海外代购经营行为作为一个新兴的经济模式,我国法律对其规制尚不能适应其特殊性,导致围绕着代购行为产生出一系列的矛盾与纠纷,这些矛盾伴随着代购行为的飞速发展而不断加剧,如不及时妥善解决,将会破坏经济秩序之安稳。分别探讨了谁有资格参与海外代购经营和海外代购经营者如何受到政府相关部门的监管,代购的产品出现质量瑕疵这一涉外纠纷如何适用法律以及如何设立瑕疵产品和失信经营者的预警机制,如何平衡民众实惠追求和国家关税收益的协调,海外代购经营者之间如何良性协作促进市场秩序的健康运行的问题。

The background of“The Belt and Road”produces the new economics model of overseas purchasing. As a neweconomic mode in our country,the law of its regulation cannot meet its particularity,leading toa series of contradictions anddisputes. These contradictions are becoming more and more serious along with purchasing behavior. If it is not properly resolved,itwill destroy the stable economic order. This article discusses who is eligible to participate in overseas purchasing operations and howoverseas purchasing managers are subject to the supervision of relevant government departments,the purchase of product qualitydefects in the application of the law and how to set up defective products and dishonest operators of the early warning mechanism,how to balance the pursuit of public benefits and national tariff revenue coordination,and how to promote the healthy operation ofthe market order with the cooperation of the overseas purchasing managers.
