醉驾及追逐竞驶视野下危险驾驶罪的立法完善

Legislation Improvement of Dangerous Driving Crime from the Perspective of Drunk Driving and Chase Race Driving

我国危险驾驶罪立法存在危险驾驶罪覆盖面过窄,醉驾标准多样,追逐竞驶涵义不明确,以及法定刑设置不合理等不足。建议从扩大危险驾驶行为种类,确立酒后驾驶分层处罚制度和区别对待追逐竞驶行为等方面予以完善。

The legislation of dangerous driving crime in China has some defects, including a narrow coverage, various standards of drunk driving, unclear meaning of chase race driving, and unreasonable penalty setting, and so on. It is sug-gested to perfect the legislation from increasing the types, establishing the stratification penalty system and differentiating chase race driving behavior.
