[目的/意义]旨在为专利侵权风险评估及预警提供参考。[方法/过程]将预警理论和方法引入专利风险应对策略,从宏观风险、重复研发风险和侵权风险分别梳理了专利风险分析方法,构建了一系列专利风险分析指标。[结果/结论]通过技术分支潜在重复研发风险评估、技术空白点分析、技术发展路线分析、重要专利保护范围分析,寻找研发项目突破口,从而有效规避重复研发;通过专利侵权风险评估及警戒和危机状态应对方案的运用,避免相关产品或技术进入市场后因侵犯第三方专利权而导致经济损失或信誉损失。

[Purpose/significance]The paper is to provide references for risk evaluation and early warning of patent infringement.[Method/process]The paper introduces theory and method of early warning into the countermeasures of patent risks, combs the patent risk analysis method from aspects of macroscopic risk, repeated R＆D risk and infringement risk respectively, and constructs a series of patent risk analysis indexes.[Result/conclusion]Through the assessment of technical branch of the potential repeated R＆D risk, analysis of technology gap, technology development route and important patent protection scope, breakthroughs of R＆D projects could be found, thus to effectively avoid duplication of R＆D. The patent infringement risk assessment and corresponding strategy of alert and crisis status is useful to avoid economic or reputational losses due to infringement of third-party patent rights when the relevant products or technologies enter the market.
