人民调解目前面临行政内卷化与专业性缺乏两大问题,究其原因,一是基层社会结构产生变化、人民调解制度更新不足;二是基层社会治理方式转变、人民调解尚未适应转变;三是基层社会需求发生改变、人民调解对此回应不够。中国共产党十九大报告提出"以人民为中心"的发展理念,这就要求在多元矛盾纠纷化解机制中让人民调解回归人民性、引入司法社会工作,解决行政内卷化和专业性缺乏的问题,让人民调解在纠纷化解中真正把好"第一道关口",在公共法律服务体系中发挥更大的作用,服务于党和国家现阶段社会治理创新的总目标。

People＇s mediation is facing two big problems of administrative involution and the lack of professionalism. The cause of the scenario lies in changes of the grass-roots social structure, insufficient renewal of people＇s mediation system and transformation in grassroots social governance mode, maladjustment of people＇s mediation to the changes and changes in social demand at the grass-root level, insufficient response of people＇s mediation to the above aspects. The 19 th CPC National Congress Report puts forward the idea of＂people-centered＂ development, which requires the return of people＇s mediation in the multivariate contradiction resolution mechanism, and the introduction of judicial social work to solve the problem of administrative involution and lack of professionalism. It will make sure that people＇s mediation guards the first pass in dispute resolution and plays a more important role in the public law service system, serving the party and the country in the overall goal of social governance innovation at this stage.
