浏览器屏蔽视频网站广告行为性质研究——关于深圳市某计算机系统有限公司诉北京某科技有限责任公司不正当竞争纠纷案的思考 被引量:13

摘要 随着互联网技术发展,视频网站日益成为公众利用网络欣赏文艺作品和获取相关信息的重要平台与手段。视频网站盈利模式通常是"广告+免费观看",网站通过广告冲抵购买正版版权及相关运营成本,并获取必要的利益。这一商业模式在现实中也被观众普遍接受。运用能够屏蔽视频网站广告的浏览器则从根本上破坏了这一合法商业模式,该行为具有不正当性,应受到我国反不正当竞争法的规制。 With the development of Internet technology, video websites have increasingly become an important platform and means for the public to use the Internet to appreciate literary and artistic works and obtain relevant information. Video website profit model is usually "advertisement + free viewing",in which the website offsets purchase of genuine copyrighted works and related operating costs through advertising,and obtains necessary benefits. This business model is also generally accepted by the audience in reality. The use of browsers that can block the advertising of video websites has fundamentally undermined this legal business model. This behavior is unfair and should be regulated by the Anti-Unfair Competition Law of China.
