论大学章程实施评估的价值基准及其指标体系

随着高等教育法治进程的推进,我国大学章程建设已经进入"后章程"时代,更为关注制定后的执行与实施。为了保障大学章程建设的效果,应该通过评估的形式来使其进一步规范与发展。大学章程实施评估的价值基准应该包括法律至上、制度理性、权力规制与权利保护等几个方面。在构建大学章程实施评估指标体系过程中,我们应该明确其重构目标,并建立包括章程规范、章程行为、章程保障和章程效果的基本框架,使其功能优势得到充分彰显。

With the advancement of the rule of law in higher education, the development of university statutes has entered the ＂post-statutes＂ era, in which the implementation of statutes after their enactment draws more attention. In order to guarantee the effect of university statutes, it is imperative to further standardize and develop the statutes in the form of evaluation. The value basis for the evaluation of the implementation of university statutes lies in legal supremacy, institutional rationality, power regulation and the protection of rights. In the process of developing an index system for evaluating university statutes, it is imperative to clarify the reconstruction objectives, and establish a basic framework including rules and regulations, activities, guarantees and effects, so as to fully demonstrate their functional advantages.
