深度链接行为的法律规制探析——兼评“腾讯公司与易联伟达信息网络传播权纠纷案”

A Study on the Legal Regulating of Deep Linking Behavior

深度链接行为是否侵害作品信息网络传播权以及对深度链接行为的性质如何认定和信息网络传播行为的判断标准等问题成为当前我国立法、司法和法学理论界关注的焦点,对这些问题的看法在理论和实务方面存在着不同的观点。本文以腾讯公司与易联伟达因侵害作品信息网络传播权纠纷一案为突破口,对相关法律问题进行概念和理论上的梳理,并对服务器标准、实质性替代标准和用户感知标准这三种观点进行简要分析,论证"服务器标准"的合理性,探讨对深度链接行为的法律规制。

Nowadays,a series of questions become focus of the work on legalization,judicature and jurisprudence,for example,what the deep linking behavior is,whether deep linking behavior infringes the right of information network communication and what the judgment standard of the right of information network communication is. There are different standpoints on these issues. To begin with,this passage mainly talks about the case which Tencent,Inc v. Yilianweida,Inc. Then,we analyze the server standard,substantive substitution standard and user perceived standard to prove the rationality of server standard. Finally,this passage puts forward measures to regulate the deep linking behaviors.
