我国民机产业立法的基本原则探析

民机产业具有重要战略地位,有关国家通过补贴取得成功。总结经验,我国选择了自主创新研制发展的道路,政府支持必不可少。在发展初期,产业能力弱小,需要国际合作。自主创新和政府支持是民机产业立法的基本原则和核心内容。此外,立法要与WTO补贴规则相协调,但不能无所作为。围绕立法核心原则科学落实有关内容,同时根据SCMs规定采用不同策略,切实为大飞机产业创造良好法制环境。

It is necessary for the Civil Aircraft industry, being a strategic value, to develop with subsidy. China finally returns to research develop CA products by innovations after practices and thinks, which needs the financial measures overly. In the primary phase, the industry needs international cooperations besides innovations. Therefore, innovations and financial measures are the basic principles and cores of the domestic industrial legislation. Moreover, the texts of the act should be practical as well as consistent with the WTO rules on subsidy. Realizing to make a better legal environment, the texts need to vary by the different subsidies under the SCMs, that will help to attain the purpose of the act.
