摘要
我国职务发明奖酬法律制度的改革与优化,包含以下四个方面内容:一是职务发明奖酬规范应当全面覆盖职务发明从技术秘密阶段到专利技术阶段的整个生命周期;二是应当克服我国现行职务发明奖酬法律制度的多元化及其相互冲突的缺点,建立整合一致的职务发明奖酬法制体系;三是我国职务发明奖酬法律制度应继续保留"上不封顶,下要保底"的相应量化规范,并进行合理的改进;四是应当弥补现行职务发明奖酬"约定优先"规范中忽视显失公平的制度缺口,明确认定显失公平者即视为在前无约定与无规章制度的情况下,直接适用职务发明奖酬法定量化规范。
The reform and optimization of service invention reward and remuneration legal system must pay attention to the following four aspects.Firstly,the service invention reward and remuneration legislation must cover the lifecycle from know-how to patent comprehensively.Secondly,because of the conflict rules in relevant regulations,we must establish a unified legal system on service invention reward and remuneration.Thirdly,the quantitative specification of "No upper limit,bottom guarantee" should be retained and improved.Fourthly,we must notice the shortage of "priority of agreement" rule if the agreement is identified as "obviously unfair",then the quantitative specification of remuneration should be applied directly.
