基于云盘之作品资源分享的侵权研究

摘要 随着云盘、社交软件的发展和普及,越来越多的著作权侵权行为转向了网络,在微博、微信公众号上,给予他人包含作品的云端网址链接,从而获得一定经济回报。这种情况越来越私人化、隐蔽化,但积少成多,这不能回避其侵权本质,也不能回避其对作者权利的极大影响。故需对相关行为予之法律定性,才能更好对之规范。 With the development and popularization of icloud and social software, more and more copyright infringements appear on the internet. Giving others icloud links containing others' works on the weibo and wechat public account to obtain certain economic returns becomes more and more personal and covertness. However, this can neither conceal its infringement nature, nor can it avoid its negative influence on the author's rights. Therefore, relevant behaviors should be legally defined to achieve good regulation.
