The Power of Technology in Rule by Law

高度发达的科学技术是衡量法治国家先进性的重要维度,科技的创新不断推动着法治社会的进一步发展,而法治的前进也促进着科学技术的更新。以科技为突破口,从物质、精神、制度等方面对科技与法治的关系及内涵进行分析,阐明科学技术是为人类社会创造大量的财富价值的第一生产力,可以得出科技为法律精神、法律关系、法律技术条件的进一步发展起着物质保障的作用。通过论证科技与法治存在互相依赖、密不可分的关系,提出当代科技的发展趋势奠定法律发展的经济基础的结论,思考在新形势下如何推进我国法治社会发展进程。

Highly developed technology is an important dimension to measure the advancement of the country under the rule of law. The innovation of technology has promoted the further development of the rule of law society,and the progress of the rule of law has also promoted the renewal of technology. Taking technology as the breakthrough point to analyze the relation and connotation between technology and law materially,spiritually and institutionally,clarifying that science and technology are the most productive forces and they have created a great deal of wealth for human society,it could be drawn that technology played a role of material guarantee for the further development of the legal spirit,legal relations and legal technical conditions. By demonstration the close relation between the technology and the rule of law,the conclusion is drawn that the development trend of contemporary technology laid the economic foundation for the development of law,and consider how to promote the development of China's rule of law society under the new situation.
