区块链智能合约的法律问题研究

Research on Legal Issues in Smart Contract of Blockchain

目前智能合约在区块链技术的支持下,运用的领域十分广泛。伴随着"互联网+"新一代革命的到来,这种新型的合约在运用中当然也会面临许多法律问题。通过简单介绍区块链智能合约的工作原理,分析归纳了其可能会涉及的相关法律问题基础上,认为在未来的商业实践中,一方面应加强对智能合约的技术性研究,建立智能合约条款语言的审查和转化标准;另一方面智能合约设计者应充分履行提示说明义务。

In recent years, with the support of blockchain technology-, the smart contract has been used in a wide range of areas. With the advent of a new generation of ＂Intemet ＋＂ , this new type of contract will certainly face many law problems during its opera tion. Through introducing briefly the working of smart contract of blockchain, the author analyzes the relevant legal issues may be in volved, holding the view that in the business of the future, on the one hand, we should develop the research of smart contract, estab lish the standard of language transfemng and examine; on the other hand, the designers should fully fulfill the obligations of presenta tion.
