论我国工匠精神培育的劳动法保障

On the Protection of Labor Law of “Spirit of Craftsman”

党的十九大报告明确提出要"弘扬劳模精神和工匠精神,营造劳动光荣的社会风尚和精益求精的敬业风气"。工匠精神是现代社会不断发展所必需的重要精神形态,具有劳资同构性、严谨性和专业性等基本特性。工匠精神培育目标的实现,离不开完善的劳动法保障。我国现行的劳动法律制度与培育工匠精神的要求尚有不相契合之处,故有必要结合工匠精神的自身特点和现实国情,在就业稳定、职业教育培训、集体劳权保护和社会保障等涉及工匠切身利益的具体制度方面,做深刻的反思,以期提出有针对性的建议。

The reports of the 19 th CPC National Congress explicitly proposed to carry forward the spirit of labor model and the craftsmen,build the social conduct of labor glorious and excelsior dedication.The spirit of craftsman is an important spiritual form for the continuous development of modern society,and it possesses such basic characteristics as isomorphism,rigor and professionalism of the labor and capital. The realization of the cultivation goal of spirit of craftsman can not be achieved without the perfection of labor law. Chinese current labor legal system is somehow not correspondent to cultivate the spirit of craftsman. Therefore,it is necessary to combine the characteristics of the spirit of craftsman and realistic national conditions to rethink profoundly on the concrete systems concerning craftsman＇s interests like dynamic stability,vocational education training,progress in employment,social security and protection of the rights and interests of the collective so that targeted suggestions can be put forward.
