摘要
盗伐、滥伐林木等肆意毁坏森林资源的犯罪行为导致森林覆盖率日趋减少,保护森林资源已经迫在眉睫。有必要厘清以盗伐林木罪为主的侵害森林资源的犯罪行为,要明确盗伐林木罪与盗窃罪之间的关系,明晰盗伐枯死林木的行为属性,廓清严重盗伐林木行为的定性障碍。要遏制侵害森林资源犯罪的"非法市场",完善对侵害森林资源犯罪的法律认定,拓宽治理侵害森林资源犯罪路径,动员多方主动广泛参与,完善非刑罚治理机制,实现治理方式多元化。
The criminal acts of vandalism,deforestation,and other deliberate destruction of forest resources have led to an ever-decreasing forest coverage rate and the protection of forest resources has become imminent.It is necessary to clarify the crimes of infringement on forest resources that are mainly crimes of illegal logging,clarify the relationship between crimes of illegal logging and theft,and clarify the behavioral attributes of illegal logging,to clarify the＂market value＂of incrimination standards of illegal purchase of illegal logging against crimes of infringement on forest resources,to improve the legal recognition of crimes of infringement on forest resources and to broaden the path of treatment against forestry crimes,to mobilize the participation of forest residents,and to improve the ecological compensation mechanism,thus to achieve diversification of governance.
