国立科研机构立法在中国为何难解?——专门立法必要性再研究

The Necessity of Legislation on National Science and Research Organization

由于诸多历史与现实原因,国立科研机构立法长期处于停滞不前的状态。究其原因是对立法必要性的理解存在相当偏差。立法缺失目前已经导致了国立研究机构健全完善现代治理的诸多困境,必须将国立科研机构立法置于国家科技治理能力和治理体系的改革框架下,从宪法责任、改革法律基础和法律治理主流范式等角度,重新厘清和明确国立科研机构立法的必要性,即通过立法形式明确国立科研机构的法律地位,设立调整规范国立科研机构管理与运行的专门性法律,是推进科技治理体系和治理能力现代化的基础性工作,也是当前科技体制改革领域亟需解决的制度建设关键议题。

Due to historical and practical reasons, the legislation of the National Science and Research Organiza- tion （NSRO） has been at a standstill for a long time. The reason is that there is considerable bias in under- standing the necessity of legislation. At present, the lack of legislation has led to the difficulties of improving and perfecting the modern governance in NSRO. Under the framework of the reform of the national S＆T governance capacity and governance system, the law on NSRO must be shifted from the constitutional responsibility, the re- form of the legal basis and the mainstream paradigm of legal governance. It is necessary to rediscover and clarify the legislation of NSRO, that is, to clarify the legal status of NSRO by means of legislation and set up a special law to regulate the management and operation of NSRO. It is to promote the modernization of S＆T governance system and governance capacity; the basic is also a crucial issue for the system construction urgently needed in the current reform of S＆T system.
