论流动人口身份的量刑偏差及控制路径

On Sentencing Deviation of Floating Population and Its Restraints

从理论和实证两个层面分析了刑事审判中存在对流动人口身份量刑偏差的现象。对此现象应持理性态度,通过对法官主体制度设计来控制,通过建立量刑大数据和实施阙值评估制度来制约,通过建立健全相关法规和组织从外部进行监督,达到相对量刑均衡与公平。

This paper analyzes the sentencing deviation of floating population existing in criminal trial from the two perspectives of theory and practice.It is necessary to adopt a rational attitude towards this phenomenon.Besides,we should control it by system design of judge as the subject,restrain it by establishing the big data of sentencing and implementing a threshold assessment system and supervise it by establishing and improving relative laws and regulations and external organization so as to relatively achieve sentencing balance and justice.
