对鉴定早产儿代谢性骨病导致骨折的再认识 被引量:3

摘要 近年来,医疗纠纷已经成为社会与媒体广泛关注的焦点,并且呈现出逐年上升的趋势。其中有患者维权意识提高的因素,也有些是恶意医闹所导致的。在这种情况之下医疗损害鉴定所发挥出的作用就变得相当重要,并且也得到了相关部门以及学者的高度重视。文章介绍一起罕见的早产儿代谢性骨病导致骨折的医疗损害责任纠纷鉴定,鉴定人充分和巧妙地利用临床资料,明确了骨折发生时间,排除助产过程造成骨折的可能,厘清两家医院的责任与过错。作者认为,应当在医学教育中增加早产儿代谢性骨病的内容,以及在司法鉴定中注意从"貌似无关,潜在有关"的资料中挖掘重要证据。 In recent years, medical disputes have become the focus of social and media attention, and show a trend of increasing year by year. Which factors improve the patient's awareness of rights, but also some malicious medical trouble caused by. In this case, the role of medical damage identifcation has become very important, and has also been highlyvalued by the relevant departments and scholars. In this paper, the rare premature metabolic bone disease cause the dispute of medical liability for damage identification of fracture, fully and skillfully use of clinical data, the expert has been clear about the fracture occurred, rule out the possibility of the process caused by fracture of midwifery, clarify the responsibilities of the two hospitals with fault. The author believes that the content of metabolic bone disease in premature infants should be increased in education, and the important evidence should be found in the information of “seemingly unrelated and potentially relevant” in judicial appraisal.
