输变电设施电磁辐射所涉法律问题及风险防控

Legal Problems and Risk Prevention and Control of Electromagnetic Radiation from Power Transmission and Transformation Facilities

经济带动电网迅猛发展,引发输变电设施电磁辐射等诸多法律问题。但是,目前国家关于电磁辐射立法层次较低,专项立法缺位严重;加之人们对输变电设施电磁辐射普遍存在认识误区,各类主体立场不同等现状,不仅造成电网企业讼累,而且社会上引起不必要的恐慌情绪。通过剖析输变电设施电磁辐射现状及涉及的相邻权、公共利益、环境安全等相关法律问题,挖掘利益冲突的深层根源,寻求多种有效的法律风险防控措施,缓释人民群众对电磁辐射的不解和忧虑,保证国民经济的安全稳定发展。

With the rapid development of power grids powered by economic demand,a lot of legal issues rise,such as concerns regarding electromagnetic radiation from power transmission and transformation facilities.Lawsuit fatigue as well as unnecessary panic have been caused by that because of the distemperedness of state legislation on electromagnetic radiation,the absence of special legislation ,the misunderstanding of the electromagnetic radiation from power transmission facilities and the different standpoints of various subjects.This paper analyzes the current situation of electromagnetic radiation and the related legal issues such as neighboring benefit,public interests and environmental safety,tries to tap the deep roots of interests conflicts and explores a variety of effective legal risk prevention and control measures to relief the anxiety of the public about the electromagnetic radiation,so as to ensure the safe and stable development of the national economy.
